Acquittal of the charge of "hit and run"
Unauthorized leaving the scene of an accident, section 142 German Criminal Code
Our client was charged in Hamburg with unauthorized leaving the scene of an accident (commonly known as "hit and run"). He was allegedly observed driving into a parked car while pulling out of a parking lot. If convicted, he would have faced a prison sentence up to three years or a fine.
The charge was particularly frustrating for the client because he had already described his perspective early on in the preliminary proceedings, there was no collision with another vehicle and no such traces found to the car he was driving at the time. Nevertheless, the court opened the main proceedings.
After preparation of the hearing dates with the client and targeted questions to the witnesses, our client was found not guilty.
