Accusation of rape dismissed
Our client was accused of raping a former employee under Section 177(6)(1) of the German Criminal Code (StGB). However, the incriminating statements made by the complainant, who has a mental disability, were, in our view, simply untenable. Upon closer examination, numerous contradictions emerged, and no coherent sequence of events regarding the alleged crime was described.
Our comprehensive written submission focused primarily on these inconsistencies, grounded in forensic psychology, while our client exercised their legal right to remain silent. This approach appeared to us as the most tactically sound strategy and was validated when we received the dismissal notice promptly on December 23rd.
For our client, this decision came as an early "Christmas gift."
