Sexual offence law
Exoneration from the accusation of a sexual offence
Termination of proceedings due to a lack of suspicion regarding the accusation of sexual assault
Our client was suspected of sexually assaulting an intellectually impaired woman. The law threatens a prison sentence of at least one year in the event of a conviction. As our client works in the social sector, his livelihood was also at stake. It was necessary to evaluate the woman's statement particularly carefully, taking her impairment into account. In addition, a detailed statement was drawn up in close cooperation with our client and exonerating evidence was presented. The public prosecutor's office followed our arguments and discontinued the proceedings as requested due to a lack of suspicion. The client is relieved and overjoyed to be exonerated of the charges and to be able to resume his work.
The proceedings described here have been concluded. The outcome of any case always depends on its individual circumstances.
